Terms of Service

Welcome to Nestful. By creating an account or using the Nestful app or website, you agree to these Terms of Service. Please read them carefully before using the service.

1. About Nestful

Nestful is a mobile application that helps parents and caregivers track product recalls, manage warranties, and organize an inventory of children's gear. The service includes a free tier and a paid subscription plan called Nestful Covered.

2. Eligibility

You must be at least 18 years old to create a Nestful account and use the service. By using Nestful, you represent that you are 18 or older. The app is intended for use by adults managing household and children's product information — it is not designed for use directly by children.

3. Your Account

To use Nestful, you must create an account using an email address and password or by signing in with Google. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Please notify us immediately at hello@getnestful.com if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe are being used fraudulently or abusively.

4. Subscriptions and Payments

Nestful offers a free tier and a paid subscription plan (Nestful Covered). Paid subscriptions are processed through Apple's App Store using in-app purchase. All billing, refunds, and subscription management are handled by Apple — Nestful does not store or process your payment information directly.

Subscription pricing, features, and terms are displayed in the app at the time of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription through your Apple ID account settings.

We do not offer refunds for partial subscription periods except where required by law or Apple's policies.

5. Free Tier Limitations

The free tier of Nestful allows you to add up to 5 products and access core features including recall checking. Additional features — including unlimited products, product scanning via photo, and warranty tracking — require an active Nestful Covered subscription. We reserve the right to adjust free tier limits at any time with reasonable notice.

6. Recall Information Disclaimer

Nestful sources recall data from publicly available government databases, including the U.S. Consumer Product Safety Commission (CPSC). While we work to keep this information accurate and up to date, we cannot guarantee that all recall data is complete, current, or error-free.

Nestful is not a substitute for official recall notices. Always verify recall information directly with the manufacturer or at cpsc.gov. Do not rely solely on Nestful for safety-critical decisions.

7. AI-Powered Features

Nestful uses Anthropic's Claude AI to help identify products from photos and match products against recall data. AI-generated identifications are best-effort and may not always be accurate. You are responsible for verifying product information before relying on it. We are not liable for errors resulting from AI misidentification.

8. User Content

You retain ownership of the product information, photos, and other data you add to Nestful. By uploading content to the service, you grant Nestful a limited license to store and process that content solely for the purpose of providing the service to you. We do not use your personal product data to train AI models or for any purpose other than operating the app.

9. Prohibited Use

You agree not to:

Use the service for any unlawful purpose or in violation of these terms
Attempt to gain unauthorized access to any part of the service or its infrastructure
Use automated tools to scrape, crawl, or collect data from the service
Reverse engineer, decompile, or disassemble the app
Misrepresent your identity or affiliation in connection with the service
Use the service in a way that could damage, disable, or impair it

10. Account Deletion

You may delete your Nestful account at any time through the Profile section of the app or by contacting us at hello@getnestful.com. Upon deletion, your account and all associated data will be permanently removed within 30 days. Deleting your account does not automatically cancel an active App Store subscription — you must cancel that separately through your Apple ID settings.

11. Intellectual Property

All content owned by Nestful — including the name, logo, app design, and written content — is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

12. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or that recall or warranty information will be complete or accurate. Your use of the service is at your own risk.

13. Limitation of Liability

To the fullest extent permitted by law, Nestful and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of — or inability to use — the service, including any reliance on recall or warranty information provided through the app.

Our total liability to you for any claims arising from these terms or your use of the service shall not exceed the total amount you paid for a Nestful subscription in the twelve months preceding the claim.

14. Changes to These Terms

We may update these Terms of Service as Nestful evolves. If we make material changes, we will notify you by email or through a notice in the app. Continued use of the service after changes are posted constitutes your acceptance of the updated terms. The effective date at the top of this page will always reflect the most recent revision.

15. Governing Law

These terms are governed by the laws of the United States and the state of California, without regard to conflict of law principles.
